Settling for silence can mean accepting pennies on the dollar from a settlement while giving up the right to talk about it or take part in a later case. Reading deeper before you sign may help, in Loren Weisman’s view.
- A settlement sent by email may be going to millions of others, which can mean pennies on the dollar.
- Some settlements may be looking for silence as much as resolution.
- Signing may keep you from being involved in another court case about the same product or service.
- A large total amount may be split a million ways.

A Settlement Email From a Big Company
In that settlement, are you settling for very little money but a whole lot of silence? My name is Loren Weisman. I’m a brand communications and optics strategist.
And you may see occasionally coming through an email about a settlement and there’s a $95 million settlement that’s a recent one from some big company, and maybe you use their product, their phone, their whatever, and they pop it in, they say, look, this is after lawyers fees and all this, this is a settlement. We’re sharing two problems.
Two Problems With These Settlements
One, if they’re sending it out to you in an email, in many cases, there are millions of others. So when you sign, or if you choose to sign that settlement, you’re making pennies on the dollar.
Second, and the bigger problem, when these people put out the settlement, they’re looking for silence. They’re stating that because you settle for 35 cents a dollar, you’re not going to talk about this stuff anymore.
And any problems that come up, referring to that product, that service, anything that comes up around that, another court case that comes, you can’t be involved whatsoever.
Reading Deeper Before You Sign
So in a sense, in a bad hype optic, some of these settlements do the finger thing, are looking to just silence you by getting you excited that you’re gonna see a large amount of money, not realizing the pie is being split a million ways to Thursday. And in that, should an opportunity down the line come, you will not be legally allowed to be a part of it.
So be careful, read a little bit deeper, take the time, dig and vet before you’d agree to some settlement that’s paying pennies on the dollar and is silencing you and preventing you from any opportunity to get maybe what’s deserved that much more down the line.
