Intellectual Property Policy

This policy sets out how intellectual property is handled in the work of Loren Weisman: what is owned, how ownership is established in client work, how it is protected, and how to request permission to use it. It works alongside the Copyright Notice, which covers use of material on this website specifically.

1. Scope

This policy covers the following categories of intellectual property:

  • Copyright. Original written, visual, audio, and video works, including articles, books, quotes, podcast episodes, transcriptions, images, and video.
  • Trademarks and trade names. Names, logos, slogans, and other identifiers used to identify this work and its source.
  • Confidential information. Methods, frameworks, client materials, and strategic work that is not published.

2. Ownership of Original Work

Original work created by Loren Weisman is owned by Loren Weisman. That includes the material published on this website and the material developed in the course of the work, unless a signed agreement says otherwise for a specific engagement.

3. Contractors and Collaborators

Where a contractor or collaborator contributes to a project, ownership and rights are set out in the written agreement for that project. Contributions are respected on the terms agreed in writing rather than assumed after the fact.

4. Client Work

In client engagements, ownership of deliverables, license scope, and the right to use the work publicly are defined in the signed services agreement for that engagement. That agreement controls. Where a client supplies material for use in a project, the client keeps ownership of what they supplied and confirms they have the right to supply it.

5. Confidential Client Information

Client information shared in the course of an engagement is treated as confidential and is not disclosed or used outside that engagement, on the terms set out in the signed agreement or a separate non-disclosure agreement.

6. Respecting the Rights of Others

Third party material used in this work is used with permission, under license, or under the fair use doctrine at 17 U.S.C. Section 107, and is credited to its source. Quotes are attributed to the person who said them. Where an attribution is wrong, it is corrected on request, as set out in the Copyright Notice.

7. Artificial Intelligence and Training Data

The use of any work covered by this policy to train artificial intelligence or machine learning models is not authorized without prior written permission. This is an express reservation of rights, including any reservation available under applicable text and data mining law. The full position is on the AI Usage Statement page.

8. Requesting Permission

To license, reprint, republish, or otherwise use work covered by this policy, write to speaking@lorenweisman.com with what you want to use, where it will appear, and for how long. Permission may be granted, granted with conditions, or withheld.

9. Enforcement

Unauthorized use may be pursued through the remedies available under copyright and trademark law. Where a use is unclear, ask before publishing.

10. Changes

This policy may be updated. The date at the top of this page shows when the most recent change was made.

Governing Law

This policy is governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. You and we agree to the sole jurisdiction of the state courts located in Orange County, Florida, and the United States District Court for the Middle District of Florida, Orlando Division, for any dispute arising out of or relating to this policy, except where applicable law gives a consumer the right to bring a claim in their place of residence.
